Terms of Service

These Terms of Service ("Terms") govern your use of Hayvens — the website, services, and tools available at hayvens.com — operated by Hayvens ("Hayvens," "we," "us"). By creating an account or using Hayvens, you agree to these Terms. If you don't agree, don't use Hayvens.

1. What Hayvens is (and isn't)

Hayvens is a marketplace that connects people offering mid-term space — homes, RV pads, garages, parking spots, and storage — with people looking to rent that space. Hosts pay an annual subscription to list; renters use Hayvens for free.

Hayvens is not a party to any rental agreement, lease, or license between a host and a renter. We don't own, manage, inspect, or control any listed space. We don't broker real estate, and we are not a property manager, real estate agent, or insurer.

2. Rent is paid off-platform

Hayvens does not process, hold, or transmit rent, deposits, or any payment between renters and hosts. Renters pay hosts directly using whatever method the two of you agree on. That keeps pricing all-in — no booking fees, no service fees — but it also means:

• You are responsible for verifying who you're paying and what you're paying for.
• Hayvens cannot reverse, refund, or guarantee any payment made between a renter and a host.
• Never wire money or pay outside the arrangement you've agreed to in writing with the other party. If something feels off, contact us before paying.

The only payments Hayvens processes are host subscription fees and optional listing upgrades, handled by our payment processor, Stripe.

3. Accounts and eligibility

You must be at least 18 years old to use Hayvens. You agree to provide accurate account information and keep it current, keep your password confidential, and accept responsibility for activity under your account. We may require email verification before you can send inquiries or publish listings.

4. Identity verification

Hayvens offers identity verification through Stripe Identity. A "verified" badge means the person completed that process at a point in time — it is not a guarantee of anyone's character, conduct, solvency, or the condition of any space. Always use your own judgment.

5. Host subscriptions and billing

Hosts pay an annual subscription per listing tier ($79/year for homes and RV pads, $39/year for garages and storage, $19/year for parking, in U.S. dollars), plus an optional one-time Boost upgrade. Prices may change; we'll notify you before any change affects your renewal. Subscriptions renew annually unless you turn off auto-renew. If a renewal payment fails, we allow a short grace period before your listings come down. Subscription fees are non-refundable except where required by law.

6. Listings and content

When you post a listing, a photo, a message, or a review, you agree that:

• It is accurate and not misleading — the price you list is the all-in price a renter pays.
• You have the legal right to offer the space, and to post the photos you upload.
• It complies with our Fair Housing & Listing Policy — no discriminatory preferences or exclusions.
• It contains nothing unlawful, infringing, deceptive, or harassing, and no malware or spam.

You keep ownership of your content. You grant Hayvens a non-exclusive, worldwide, royalty-free license to host, display, and reproduce it for operating and promoting the marketplace. We may remove content or listings that violate these Terms.

7. Your local obligations

Hosts are responsible for complying with all laws that apply to their rental — including zoning, licensing, rental regulations, lead-paint and habitability disclosures, tax obligations, and HOA or lease restrictions. If you rent a space you don't own, confirm you have permission to offer it.

8. Prohibited conduct

• Misrepresenting yourself, a space, or a price.
• Discriminating against renters or hosts in violation of fair-housing laws.
• Using Hayvens to collect fees Hayvens's pricing model doesn't allow you to charge.
• Scraping, reverse-engineering, or interfering with the service.
• Circumventing safety features, or contacting users for purposes unrelated to a stay.

9. Reports, suspension, and termination

You can report a listing, user, or message to us at any time. We may investigate, remove content, suspend, or terminate accounts that violate these Terms or create risk for the community. You can stop using Hayvens and delete your account whenever you like.

10. Disclaimers

Hayvens is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that listings are accurate, that spaces are safe or as described, or that the service will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Hayvens will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any dispute, loss, or damage arising from a rental arrangement or payment between users. Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid Hayvens in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold Hayvens harmless from claims arising out of your content, your use of the service, your rental arrangements, or your violation of these Terms or of any law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Denver, Colorado, and you consent to their jurisdiction. Please contact us first — most issues are fixable with an email.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify you by email or in-product notice before it takes effect. Continuing to use Hayvens after a change takes effect means you accept the updated Terms.
